Data Security

Your film is never stored on our servers after analysis. All uploads handled via your secure file link. Results delivered via encrypted Dropbox link. Files permanently deleted from our local systems and cloud storage within 7 days of delivery.

Your Obligations

By submitting a film, you confirm that you own or have obtained a valid license. You agree not to upload unlawful, defamatory, or infringing content.

No Warranties (AS-IS)

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. YOU ASSUME ALL RISK FOR ANY DECISIONS MADE BASED ON ANALYSIS RESULTS.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOLLYLYTICS AND DESIGNER STRATEGIES LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE ANALYSIS.

Indemnification

You agree to indemnify, defend, and hold harmless Designer Strategies LLC (dba Hollylytics) and its members, managers, officers, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your violation of these terms, (b) your infringement of any third-party rights (including copyright claims related to submitted films), or (c) your use of the analysis results.

Payment Terms

Payment is due before delivery of analysis results. Turnaround time begins once payment is confirmed. All sales are final. No refunds will be issued once analysis has commenced.

LLC Protection

All obligations of Hollylytics under these terms are solely the obligations of Designer Strategies LLC. No member, manager, or agent of the LLC shall have personal liability for any such obligations.

Patent & Intellectual Property

Patent-pending (inventor: Raji Jaber). System and Method for Quantifying Emotional Elements in Video Content as Screen-Time Percentages. Provisional filed May 2025. Non-provisional filed April 2026 (USPTO). Unauthorized reverse engineering, copying, or reproduction of any Hollylytics methodology or code is prohibited.

Trademark

Hollylytics™ is a pending trademark owned by Raji Jaber. All rights reserved.

Governing Law & Dispute Resolution

This agreement shall be governed by the laws of the State of New York. Any disputes arising from this agreement shall be resolved through binding arbitration in New York County, New York.

Severability

If any provision of this agreement is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

Acknowledgment

By submitting a film and completing payment, you agree to all terms above.
